I am sure what you have said is true in many states, but I have found that definition of terms, like waiver law, differs from state to state. I know that you are as hard to convince as I am, so we can agree to disagree on a few things.

By the way, I have been enjoying your newsletter -- would like to see more recent cases discussed.

		<description>Release is the proper term. Waiver is used in the southeast. An Express Assumption of Risk is not a waiver in any jurisdiction. It has a completely different standard or review applied to it than a waiver. An Express Assumption of Risk is an Assumption of Risk Agreement. A Parental Permission Form with an exculpatory clause in 4 states does provide protection for the provider. An Informed Consent Agreement does not release a provider from any liability.</description>
