Northwest Nazarene University required Morrison and some co-workers to participate in a “team building exercise” that included, among other things, a climbing wall activity. Morrison fell, was seriously injured, and sued alleging negligence (Morrison v. Northwest Nazarene University, 2012 Ida. LEXIS 82).

Waivers, Employer/Employees, and Bargaining Position

Employers are considered to have a superior bargaining position over employees. For this reason, as a general rule, waivers which employers require employees to sign are generally considered to be in violation of public policy and unenforceable. AthleticBusiness.com reported an article in The Columbus Dispatch regarding YMCA negative reaction to House Bill 143 which includes mandated concussion education and requires an authorized doctor to sign off before an athlete can return to play after a concussion. The bill provides some immunity provisions which YMCA official Beth Tsvetkoff terms as inadequate.

Tony Weathers, a 30 year old fit athlete drowned in a Fort Worth’s “Original Mud Run” competition on April 14. Courts in some states require that the word “negligence” be included in a waiver. Some strongly urge the use of the term. Others simply specify that the intent of the waiver to cover negligence must be clear.

Two recent events accentuated the importance of an AED for your sports event or facility. The events involving young soccer players illustrate similar incidents, different preparation for emergencies, and different results &#8212; one player lives and another dies.

In Waivers &#38; Releases of Liability (7th ed.), this author devotes two entire chapters (More than 50 pages) to how to write an effective waiver. One can construct a great waiver by following the guidelines presented. However, waivers don’t always work as expected. Over the last several years it seems that there is a rash of failures because the waiver was 1) too narrowly constructed, 2), overly broad or 3) did not specifically name a party seeking protection.
